About CNSM

The National Trade Union Confederation of Moldova (CNSM) is a national interbranch trade union centre of confederal type, which meets on voluntary basis national-branch trade union centres and is independent of public authorities, parties and other socio-political organizations, employers’ associations and public organizations, is not subject to their control.

National Trade Union Confederation of Moldova consists of 25 branch federations, comprising over 400 000 trade union members. Among them, there are employees from education and science, agriculture and food, social services and production of goods, communications, constructions, light industry, consumer cooperatives, trade and business, chemical industry and energy resources, culture, employees of the Ministry of Internal Affairs, state bodies and other branches.

CNSM is a  member of the General Confederation of Trade Unions (Moscow).

Since February 2010, CNSM is a member of the International Trade Union Confederation (ITUC), which meets 331 national trade union centres from 163 countries and regions covering 202 million members.

The fundamental principles promoted by the CNSM are democracy, freedom, solidarity, transparency, equal rights and opportunities.

The confederation has the following main purposes: national representation and protection of rights and socio-economic, professional, labour, collective and individual interests of trade union members; updating and developing of social dialogue and social partnership; the progressive realization of social justice and dignity of work; strengthening trade unions at all levels and consolidating the relations with the civil society;

The stated goals are achieved by CNSM based on: negotiations and conclusion of collective agreements at national level; representation of member organizations on equal terms with the social partners in the administration of state social insurance budget, healthcare insurance funds, unemployment etc; participation in drafting programs, laws and other normative acts aimed at regulating the rights and professional, labour, economic and social interests of trade union members; providing legal assistance and defence of collective and individual interests of its members at all levels, including in the courts; monitoring compliance with the International Labour Organisation Conventions, ratified by the Parliament of the Republic of Moldova.

CNSM was established on the 7th of June 2007 by the merger of two national-interbanch trade union centres: Confederation of Trade Unions of the Republic of Moldova and Confederation of Free Trade Unions of the Republic of Moldova “Solidaritate”.

Confederal Committee

Composition

(1) The Confederal Committee is constituted according to criteria established by the Rules of the Confederal Committee and includes one representative of each member organization.

(2) The representatives of member organization in the Confederal Committee are appointed / revoked by competent authorities thereof.

Convening

  • The Confederal Committee operates in accordance with the Rules approved by the General Council and shall hold meetings whenever necessary, but not less than once every three months.
  • The Confederal Committee decides by simple majority of votes cast, unless otherwise expressly provided for in the Statute, just if the meeting is attended by at least 2/3 of voting representatives of member organizations.
  • If the meeting does not meet the majority provided in par. (2), it shall convene another working and deliberative meeting in the presence of at least half plus one of the members of the Confederal Committee.
  • The president of the Confederation determines the date, place and agenda of the meeting of the Confederal Committee.
  • At the request of at least 1/3 of the members of the Confederal Committee, member organizations which represent at least 1/4 of the number of trade union members of the Confederation, the Confederal Committee will be convened urgently to date that will be determined under the provisions of Rules of the Confederal Committee.

 

Attributions:

(1) The Confederal Committee is the governing body of the Confederation during the period between meetings of the General Council.

(2) Confederal Committee:

  • defines the positions of the Confederation in current national and international trade union issues;
  • meets resolutions and decisions of the Congress, the General Council, developing specific action plans;
  • convenes the Extraordinary Congress in terms of this Statute;
  • considers applications for affiliation to national-branch trade union centers;
  • examine the draft collective agreements (national level), appoint representatives of the Confederation in the National Commission on consultations and collective negotiations, in other working bodies in the social partnership;
  • manages, jointly with social partners, state social insurance budget and administers national funds created with the contribution of employees;
  • possess, use and dispose of the assets of the Confederation and manages special funds thereof;
  • decide triggering protests;
  • coordinates the work of women’s organizations, youth, educational Council, Labor inspectorate of trade unions, other trade union structures created by the Confederal Committee, shall adopt rules of their organization and functioning;
  • presents to the General Council annual reports on its work;
  • approves the structure of the staff of the Confederation;
  • exercise other powers delegated by the General Council;
  • delegates powers it finds necessary to the president of the Confederation.

 

General Council

Composition:

(1) The General Council is composed of:

  • a) representatives of member organizations, depending on the number of trade union members and level of contributions to the Confederation;
  • b) president, vice-presidents and confederal secretary.

(2) The competent bodies of member organizations entrust/ revoke their representatives.

 

Convening:

  • The meetings of the General Council are convened by the Confederal Committee whenever necessary, but not less than once a year.
  • General Council is considered deliberative if there are at least 2/3 of representatives of member organizations with the rights to vote.
  • General Council takes decisions by a simple majority of the votes cast, unless otherwise expressly provided in the Statute.
  • If the meeting does not meet the majority provided in paragraph (2), within 15 calendar days shall be convened a new General Council that would be deliberative with the presence of at least half plus one of its members.
  • Usually, the Confederal Committee establishes the date, place and agenda of the General Council.
  • By derogation from paragraph. (1), at the request of the competent bodies of at least 1/3 of member organizations, representing at least 1/4 of trade union members of the Confederation, the General Council shall be convened by the President of Confederation.

 

Attributions:

(1) The General Council is the governing body between congresses and operates under own rules.

(2) The General Council:

  • decides on general matters regarding the activity of the Confederation, determines trade union policies and strategies for achieving the action program established by the Congress;
  • amends the Statute with at least 2/3 of votes of all members of the General Council;
  • approves the regulations of organization and functioning of the General Council, Confederal Committee and Audit Committee;
  • validates the empowerments of the members of the General Council appointed by the member organizations of the Confederation;
  • validates the mandate of the members of the Confederal Committee and notes the revocation of representatives of member organizations;
  • elects and dismisses members of the Audit Committee in case of resignation, change of employment, violation of the Statute of the Confederation, committing acts which by their effect may prejudice the interests and image of Confederation, legally motivated;
  • adopt and amend the annual budget of the Confederation, determines the size of the membership fee;
  • revokes the president, vice-presidents, the confederal secretary, president of the Audit Committee in case of resignation, change of employment, violation of the Statute of the Confederation, committing acts which by their effect may prejudice the interests and image of Confederation, legally motivated;
  • elects, in case of vacancy of the position of president, vice-president/s, confederal secretary, president of the Audit Committee, no later than 90 calendar days, other persons which continue execution of the mandate of powers of the predecessor/s;
  • expresses, if necessary, for the validity of decisions of the Confederal Committee and of the president of the Confederation;
  • if requested, interprets the Statute and regulations of the structures of the Confederation;
  • decides on affiliation / withdrawal of the Confederation to / from international trade union organizations;
  • delegates powers it finds necessary to the Confederal Committee.


The Congress

The Congress is the supreme governing body of the Confederation.

  • The ordinary Congress is convened by the decision of the General Council every five years. The General Council shall prepare the agenda of the Congress at least three months before its carrying out.
  • The Congress is deliberative in the presence of at least two thirds of the delegates that have mandates of the majority of member organizations with the right to vote.
  • The Congress takes decisions by open vote by simple majority of votes cast, if there are no other specific provisions under the Statute.
  • Election of delegates to the Congress is going according to statutes of the member organizations, according to norm and procedures established General Council, based on the number of trade union members and the payment of contributions to the Confederation between congresses.

Department of organization, education and information

The Department of organization, education and information of the National Trade Union Confederation of Moldova has the competence to promote the principles of the trade union movement; monitor compliance with the Statute of CNSM; implement the decisions and resolutions of congresses, conferences, meetings of the General Council and the Confederal Committee; plan and coordinate joint actions of the General Council, the Confederal Committee, national-branch trade union centres on the organizational, education and information activity; record trade union statistics; coordinate the activities of  Women Council, Youth Commission; organize and train trade union members.

Department of social - economic protection

The Department of social – economic protection of the National Trade Union Confederation of Moldova expertise draft laws and other regulations on economic and social issues and submits respective proposals and objections to central public administration; participate, as appropriate, in parliamentary and government committees to examine the drafts of legislative acts related to economic and social rights of the population; collaborates with social partners and other institutions and organizations in the country in issues related to social and economic protection of employees; examines key indicators characterizing social and economic situation of the country, including in the area of remuneration, development of social dialogue, study the living standards of the population, the labour market situation and submits corresponding proposals; deal with complaints; provides instruction and practical help.

Legal Department

The legal Department of the National Trade Union Confederation of Moldova represents and defends the rights and professional, economic, labour and social collective and individual interests of trade union members with public authorities at all levels, public associations, with employers and their associations; examines current and future issues of legal nature concerning interests of trade union members; monitor violations of trade union rights. It also assists members with legal problems arising from labour relations and examines their petitions; assists trade unions in the proper application of labour law and legislation on trade unions, but also in examining and solving individual disputes and collective conflicts. Participates in legal training of trade union members.

Labour Inspectorate of Trade Unions

The Labour Inspectorate of Trade Unions exercises control over compliance with labour law and other normative acts in the field of labour in enterprises, institutions and organizations with any type of property and legal form of organization, where trade union organizations operate.

Labour inspectors of the National Trade Union Confederation of Moldova provide free consultations in the field of occupational health and safety and work relations, which refer to violations of labour rights of workers and trade union members, working conditions, collective and individual labour conflicts.

Department of mass media and international relations

CNSM structures


Audit Committee

The Audit Committee is the body for controlling the economic and financial activity of the Confederation and is independent in its work. The Audit Committee shall operate in accordance with the Regulation approved by the General Council.

The Committee shall report on its work to the Congress and shall inform the General Council and the Confederal Committee annually, as appropriate, on the results of the checks carried out.

Women Commission

Women Commission is a structure of the National Trade Union Confederation of Moldova, which aims to protect labour, economic and social rights of women trade union members by monitoring compliance with legislation regarding the protection of labour and social rights of women; active participation in realization of trade union policies; cooperation with state structures and civil society through cooperative efforts to strengthen favourable environment to democratic changes, setting up a society with equal rights and opportunities for women and men.


Youth Commission

Youth Commission of the National Trade Union Confederation of Moldova has the following tasks: implementation of the youth policy of CNSM, the consolidation of the shares of young trade unionists to protect the rights and interests of young trade union members; develop and submit proposals for improving the legal and regulatory framework in the youth field; organization of information activities on the actions of CNSM and creation of positive image  of trade unions; participation in trade union education process of young people and attract them in the trade union movement; multilateral cooperation with similar youth organizations nationally and internationally.

Labour Institute

Labour Institute is the pillar of education and training of trade unionists within the National Trade Union Confederation of Moldova. Its activity is focused on the following main areas: coordination and implementation of science teaching methodology of the education system of CNSM; development of training programs for trade union officials and activists and thematic programs; train staff and trade union militants of national intersectoral level; offers methodical assistance for training process at different levels; development of studies, opinion polls, analyses, scientific research in areas of trade union interests.
